THE RIGHEIMER/MENSINGER  LAWSUIT--THE DP HAS ADDED MORE INFORMATION TO THE ARTICLE THEY RAN YESTERDAY


The haters are still calling for Mayor Mensinger and Mayor Pro Tem Righeimer to drop their civil lawsuit.

The mayor and mayor pro tem would be nuts to do so and I'm sure their attorneys are advising them to continue with their civil case at the same time as the criminal case moves forward.

Different burdens of proof and damages

Criminal cases require a higher burden of proof than a civil case, and that's one reason to continue with the civil case.  In addition, in a civil case Mensinger and Righeimer can get damages for the harm done to them, while in the criminal case they may only get simple satisfaction that those who broke the law were brought to justice or at least were brought to trial.

What's Next

My guess is that the civil suit will be amended to add at least one new name, but it wouldn't surprise me if more than one new name is added.  Eventually (and things are starting to move there now), the appellate court will rule on the SLAPP motion and my guess is that the court will allow discovery to move forward.  This means that some cops will be deposed and will be subject to other forms of discovery.  When that happens, more names may be added to the civil suit.

The Haters and Morale

The haters claim that the civil lawsuit hurts police morale and this is why the mayor and mayor pro tem should drop it. This is nonsense.

The reality is that  the good cops in the department and the new ones who have been hired have their morale harmed by having bad cops in their midst.  Not by the lawsuit.

What happened to the mayor and the mayor pro tem is a taint on the whole department.  And, bad apples in the department who constantly bad mouth the mayor and mayor pro tem are the ones who can hurt morale and  hiring efforts and they can poison the well for new police officers who join the force.

Remember, police officers are city employees.  They do not run the city.  They were not elected. They must answer to the City CEO and he answers to the City Council. That's the chain of command.

Have you ever worked for a company with even one mouthy and negative bad apple? 

Their negative attitude toward the company and their bosses has a corrosive effect and hurts the whole organization.


This effect is even more pronounced in police organizations which have a quasi-military structure and a mission that causes the cops to have a psychological distance from citizens and a psychological closeness to one another.  The "thin blue line' comes to mind as one expression of this, and one might even say it can  become an attitude of "us against them," in some departments.

And, we're seeing some of that "us against them," attitude in the present situation.

Tip of the iceberg?

Some of those who want the mayor and the mayor pro tem to drop the civil lawsuit are trying to portray the  us against them attitude as coming from the mayor and the mayor pro tem, as though the mayor and the mayor pro tem are the bad guys.  They're not.  They're innocent victims.

They have been harmed.  And, had the private eye not been found out, the mayor and the mayor pro tem and even Councilmember Monahan could have had their whole lives and the lives of their families destroyed and their reputations ruined.

Put yourself in the shoes of the mayor and the mayor pro tem and you certainly must feel a shudder up your spine--false DUI report, tracking devices, a looker sent in to entice a councilmember and who knows what else?  This may just be the tip of the iceberg that we know about at this time.

Even before Mr. Righeimer was elected, some in the  police department started their campaign against him and the cop groupies among the haters also started bad mouthing him and they're still at it.

The mayor and the mayor pro tem are not alone in wanting a professional police department.

And those haters who are trying to portray this matter as some sort of private war between the mayor and the mayor pro tem on one side and the union on the other have it dead wrong.

The mayor and the mayor pro tem have thousands of Costa Mesa citizens behind them in wanting to see justice done in the criminal case and to have the mayor and mayor pro tem be made whole again via the civil suit and to have professional police officers on the force who are dedicated to their profession and who will act in the best interests of the people they serve and not themselves.

If you're a retailer with the right products/services, you might want to try to get into that area right away before lease rates/land sale prices go through the roof.

BOSTON--TIME CAPSULE FROM 1795 FOUND AT STATEHOUSE--DEED FROM MILLARD PART OF IT?

The Statehouse sits on Beacon Hill which was owned by a Millard before it was sold to the state way back then.  However, the Millard in question seems to have been from a  branch of the family that came over  from England very early, while my branch came over from Ireland during the potato famine--probably in steerage.

Here's this important issue once again:  Can any nation in the modern world be for just one people, or must every nation be like the Star Wars Bar?

Some of us believe that nations should be allowed to be for one people.  And, this is what many nations were originally.  They were families that grew to villages to towns to cities and to nations, where most of the citizens were closely related in some meaningful manner: genetics, religion, etc.

MISS.--BURNING DEATH OF 19-YEAR-OLD JESSICA CHAMBERS

There's some unconfirmed Internet buzz that the Community Relations Division of the DOJ has sent people to the town where the burning happened to try to do a PR number and  tamp down speculation that it was a Black who killed Jessica by pouring a flammable liquid inside her nose and mouth and then setting her on fire.  If the buzz is true, one of the moves of the PR types would most likely be to delay the investigation until the story dies down and is forced off the front page  by other stories.

  1. just went to the Pilot to read hater comments. apparently the story of the PI arrests are already old news. nowhere to be seen on the front page, but there is a letter about cops earning their pensions.
