Obama is not likely to take the advice and is expected to announce tomorrow (Tues. 12/1)that he's sending 30,000+ more troops to Afghanistan. This will truly make this Obama's war. This won't endear him to many thinking conservatives (which is what he may be trying to do), and it'll anger many of his supporters.

The first contingent,according to some reports, is to be 9,000 Marines who will charge into Helmand Province and kill or drive out as many Taliban as possible.

They will be followed by 1,000 U.S. Army soldiers who will hold the areas cleared of Taliban by the Marines and try to set up puppet governments by handing out U.S. tax dollars to anyone who pretends to be our friend.

Saturday, November 30, 2009--3:00 PM--Serious hit and run collision on Baker Street east of Fairview in front of Baker Party Rentals next to the Del Taco. Car upside down on its roof. Sole occupant extracted by CMFD and taken away in an ambulance. The other car sped away and was followed for a short time by a motorist who apparently lost sight of the car. CMPD helicopter has been making ever wider circles over the area apparently to try to locate the car which must have serious front end damage.

CM PRESS NOTE: Once, when we were paying full price for food for one of the junior Presses at a local grade school, we checked to find how many other parents were paying full price. It was a tiny fraction. Most of the 300 or so kids were getting free or reduced rate food. We also noted that the trash can was full of food every time the kids ate. Easy come, easy go. If the parents of those kids actually had to pay for the food, they might tell their kids not to throw it away.

The other thing we noticed at this grade school was that most of the parents of the children receiving free or reduced rate food were driving newer model cars. When you're on the Illegal Alien Plan For Fleecing America, you can afford the nicer things in life.

DENVER COPS ARREST 32 BLACKS FOR HATE CRIMES AGAINST WHITES AND LATINOS
It's very rare for blacks to be charged with hate crimes against whites. Cops in many jurisdictions seem to bend over backwards to find some other cover motive when blacks attack whites. Perhaps blacks got hate crime charges in these Denver cases because they also attacked Latinos.

MORE ON THE COSTA MESA FAIRGROUNDS

In our view, some of the arguments we've seen about stopping the state from selling the Fairgrounds don't seem to make much sense.

One pervasive argument holds that we already own the Fairgrounds and we shouldn't even be considering buying what we already own.

Well, actually, the State of California owns the Fairgrounds. Yes, in a larger sense, that means the citizens of California--all the citizens--own it. However, the citizens have given authority to the state government to handle such things as buying, using, holding and disposing of property such as the Fairgrounds. Again, the STATE owns the property.

It is not just the citizens of Costa Mesa or Orange County who own the Fairgrounds.

Another thing we've noted is that some of the local folks who have been the loudest voices against telling others what to do with their property, now seem to have changed tune and want to tell the state what it can do with the property that, as already mentioned, is owned by the state, as authorized by all the citizens of California.

And, what about this talk of offering $25 million for the Fairgrounds in some sort of Orange County and Costa Mesa joint effort? In the first place, the Fairgrounds can't be properly valued for its lowest and worst use, which is what that $ 25 million represents. Instead, it must be valued at its highest and best use. Frankly, if the state sold the property for far less that it's worth, it might face some serious law suits.

The most likely way that the sale will be called off--if it is called off--will be if the state doesn't
receive any legitimate offers for what the state thinks the property is worth. That means, we think, that the state would like to see offers in the $ 200 million range, not $25 million, but might cave at around $ 125 million on a very clean offer with few contingencies.

Costa Mesa Police Department Enforcement Campaign
Targeting Motorcycle Safety

The CMPD will be out this Saturday looking for dangerous riders and careless motorists

The specialized Motorcycle Safety Enforcement Operation will be patrolling areas frequented by motorcyclists and where crashes occur. Officers will be cracking down on traffic violations made by motorcyclists as well as other vehicle drivers that can lead to motorcycle collisions, injuries and fatalities.

Motorcycle fatalities have been on the rise in California, increasing 175 percent in the last decade, from 204 killed in 1998 to 560 killed in 2008. The data for Orange County has also been compelling; in the five year period from 2004 through 2008 there have been a total of 141 fatal and 3,445 injury motorcycle collisions in the county.

Riders can get training through the California Motorcyclist Safety Program. Information and training locations are available at www.CA-msp.org or 1-877 RIDE 411 or 1-877-743-3411.

Funding for this program is provided by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

"Now look you two. We have a $21 billion shortfall that we have to make up.

"Not only are we going to sell the Fairgrounds, but you know that view of the sky when you look up? We're also selling that. And, you know that oxygen you've been breathing down there in What's its name Mesa, we're going to tax that. And, if you or your City do anything to try to stop the sale of the Fairgrounds or if you scare off any buyers of cause us to not sell it for what we should get for it, we're going to sue you individually and as a city. Got it?"

ON THE FAIRGROUNDS
The Council also moved to take various steps to derail
the sale of the Fairgrounds. Among these will be a personal visit to Governor Schwarzenegger by Councilmembers Leece and Foley who will hand carry a letter asking him to stop the sale. The Council will also move forward with a ballot initiative to try to lock in fairground zoning. And, the Council will also try to have Costa Mesa buy the Fairgrounds if all else fails. The packed audience frequently clapped approval for what the Council is trying to do.

A LITTLE REALITY ABOUT THE FAIRGROUNDS SALE

--The State is marketing this property internationally. Our guess is that bids will be received from concerns in China, Japan and the Arab Gulf States, among others. We believe that some of these bids will be very high given the fact that some of these international bidders are used to land being very dear in their nations and some of them take a long view of history. THIS MEANS: The chances of Costa Mesa buying the property as the high bidder are slim. Plus, Costa Mesa is already $19 million in the hole.

--We believe that sophisticated bidders will not come in with clean offers. THIS MEANS: The bids will have a number of contingencies including, probably, demands that the State guarantee that the property will be able to be used for its highest and best uses and that the State will indemnify and agree to defend any purchaser against lawsuits from Costa Mesa and any others who assert standing.

--We believe that the sale of the Fairgrounds is being driven by South County interests. THIS MEANS: As we've previously written, the center of gravity of Orange County has now moved south. Political and business interests in South County want to make that even more so.

--At last night's meeting, if we heard her correctly, Councilmember Foley said that by law a county must have a Fair, and she said that if the Costa Mesa Fairgrounds is developed, there is no place for a Fair in the county. (?) THIS MEANS: Huh? See the entry above. The County Fair will move to the Great Park.

--We believe that the State is going to play hard ball with Costa Mesa and threaten some major legal action. THIS MEANS: This may be behind closed doors, but we believe the State is serious about selling the Fairgrounds and will threaten Costa Mesa with lawsuits that can bankrupt the City.

--We believe that the State may also pass bills to get around any zoning or other restrictions that Costa Mesa (and any other cities or counties) try to enforce on State owned property. THIS MEANS: In the legislature, Costa Mesa will be portrayed as flipping off the State, and the legislators will move to put down the rebellion in Costa Mesa.

--We believe the best chance to derail the sale is if all the bids that come in are too low.
THIS MEANS: Despite representatives for the state telling Costa Mesa that they don't know what the land is worth, they still have a secret tipping point. If that secret tipping point isn't met in any of the bids, the property will be taken off the market. But, if the State believes that the reason the bids were too low is because of actions by Costa Mesa to scare off buyers, the State may sue Costa Mesa.

It turned out that 9159 years after Cheddar Man died, two school children in the village were exact mtDNA matches--meaning that they are in Cheddar Man's direct line--his great,great, great, great, etc. grandchildren. In addition, the school's history teacher was a close match to Cheddar Man.

CITY COUNCIL MEETING TONIGHT

At tonight's City Council meeting, Councilperson Flopsy Katrina Foley is going to ask the full Council for permission to send a letter to Governor Schwarzenegger asking him to cancel the
sale of the Fairgrounds.

We have some tongue in cheek thoughts about this.

The last letter Flopsy said she was going to write was to President Bush asking him to secure our borders. So far, Flopsy hasn't written that letter and Bush is long gone.

Flopsy was also involved in the group that was going to put a new airport in El Toro to stop John Wayne from expanding. You know how that went.

But there's more. Back when the Job Center was being closed down, Flopsy met with a bunch of Spanish speaking day workers (including, presumably, some illegal aliens) and let them know through a translator that she was their pal.

So, connecting up the dots, one wonders if Flopsy's letter will ever be done. And, while we wait for it to be written, will John Wayne Airport buy the Fairgrounds and put in runways so planes full of illegal aliens from Mexico can fly directly into Costa Mesa instead of taking the long route?

Seriously, though...

Aren't you sick of politicians who say one thing and do another?

Aren't you also sick of numbnut citizens who buy the crap the politicians say, and believe that something is being done, when it really isn't?

Foley actually did sit on the dais and refuse to sign a letter to then president George Bush asking him to secure our borders. All the other Councilmembers signed the letter and sent it. Foley told the citizens of Costa Mesa that she was going to write her own better letter. She has never done this, as far as we know.

Foley also really was/is involved in a group that says it wants to keep John Wayne from growing, but they failed to stop the Great Park and their present efforts look to us to be on the level of a school announcement for the kids to duck and cover because a nuke is going off in the school yard.

And, yes, Ms. Foley really did meet with dayworkers as outlined above. It happened at the Senior Center.

Here are a few more thoughts.

The sale of the Fairgrounds is not being pushed by Governor Schwarzenegger, but by the legislature. We don't think Schwarzenegger can do much about it.

We also think that the South County Great Pork folks are pushing for our Fairgrounds to be sold so that part of the Great Pork will be the new Orange County Fairgrounds and Event Center. They don't want a rival bleeding off entertainment and other dollars.

Our guess is that the Great Pork folks want all eyes to be on the Great Pork and for it to be THE center of OC for just about everything, including performing arts, the annual fair--and, hey, maybe they'll even nick the Costa Mesa Fish Fry and turn it into the Great Pork Fish Fry.

We also believe, from past examples (think, the El Toro fiasco) that they have more political clout than pols in our part of the County.

Oh, by the way, we have a copy of an ad the state ran on 11/4 in the Wall Street Journal seeking buyers for the Fairgrounds, and we also have a copy of an article from the 11/9 California Real Estate Journal; which is a trade paper that is widely read by developers and other movers and shakers involved in high stakes real estate deals, letting the high rollers know that the property is on the market.

The point is that this isn't a stealth deal. The state is making a serious effort to sell the Fairgrounds and they're letting it be known where the big money gets its information.

Also, the WSJ ad says this: "150+-ACRES LOCATED IN COSTA MESA, CA 45 MILES SOUTH OF DOWNTOWN LA."

Get it? The state knows that a big bucks buyer is most likely to come from outside of California and more than likely from overseas. That's why the ad gives the site's location in relation to LA.

China or an Arab nation are likely bidders. Japan is having financial troubles, but we expect a bid from there as well.

Personally, we think the ad would have been more effective if it had pointed out that this Fairgrounds is not out in the boonies--as are most fairgrounds--but is right in the center of a city. Oops. We shouldn't be giving them any ideas.

A sophisticated bidder is going to want indemnification and assurances from the state that the property can be developed. This means lawsuits, if Costa Mesa tries to restrict the use of the site.

Both cars reportedly had multiple passengers. The wrong way driver reportedly ran off but was aprehended by CMPD in a nearby neighborhood.

He's apparently finally caught on to a truth of nature and is now already telling his 7-year-old son that the son should marry an Indian.

The newspaper couches the story in the usual PC psychobabble and calls it a "sticky issue." It's not. It's very simple and it's very direct. Practice miscegenation and you change your family's genetic recipe.

Human beings are not fungible. We are all different and we are all different primarily because of our genetic recipes. It is these genetic recipes mixed with various accidents of evolution and fate which caused us to create our various cultures as we adapted to various environments and conditions over the centuries.

It looks as though many of the foundations have now been poured
in this nice little project that will be a plus for Mesa del Mar and the north part of Costa Mesa.

As you may recall, this is the site of a former decrepit shopping center across from the Mission-Mendoza slum in Councilmember Foley's neighborhood.

Hopefully, the folks who buy these homes will demand that something be done to thin out the slum across the street from their homes.

Say, maybe they can tell the Costa Mesa City Council (and especially, Councilmember Bever) about the great work that the Stanton City Council is doing to rid their city of slums.

What an insult. The landlocked City of Stanton is actually doing a better job than ocean close Costa Mesa in taking the necessary steps to improve their city.

A FEW THINGS TO BE CHECKED--FAIRGROUNDS

We don't have the time or the inclination to make the phone calls on this, but some of what was said at the meeting on Monday about the sale of the Fairgrounds might have been misleading to a casual listener.

Here's the relevant part of the story in the almost daily Daily Pilot about the meeting. The CM PRESS's comments are in [].

County Treasurer Chriss Street detailed estimated financing costs for every $10 million of borrowing, should a private or public entity try to purchase the fairgrounds.

With an estimated $2 million profit per year [That profit info probably shouldn't be run on with what follows], financing costs would range from $655,000 per year for an AA General Obligation bond to $1.37 million annually for a private option with 50% equity, Street said. [Remember, those amounts are per each $ 10 million borrowed. Thus, on the private option, the mortgage payments would be (in round numbers) about $113,547.00 per month for each $ 10 million borrowed.]

He also gave a stark example of declining property values: the Heritage Fields property in Tustin, which went from a high appraisal of $365 million to $85 million in a year. Citicorp, which is funding development on the property, appraised it at just $42 million, he said.
[Someone might want to check with Mr.Street on these figures. Mr. Street may be correct, but we think they need checking.

[Here's why. What looks like a precipitous drop from $ 365 million to $ 85 million to $ 42 million in appraised value may be a misreading of the figures.

[The first figure, $ 365 million, may be an appraisal figure and the second figure, $85 million, may possibly be an appraisal figure (but this needs to be checked). However, the third figure of $ 42 million might not be an appraisal figure, but an LTV figure (often about 50% on appraised value on raw land) or it may be a construction loan.

[Again, we're just throwing this out there for anyone involved in the groups that want the City to buy the Fairgrounds to check. We don't have time to check these figures.

[Why this is important for those who want the City to buy the Fairgrounds

[These "appraisal figures" may be giving some folks hope that the citizens of Costa Mesa have a chance of buying the Fairgrounds at a song because land values have dropped so much--$ 365 million to $42 million, in the above example--but land values may not have actually dropped that much.

[If any readers check with Mr. Street, please drop us a note about what you learn.]

There's lots of noise being made right now about how Costa Mesa is going to either stop the sale of the Fairgrounds or is going to control its uses.

Some of this is probably just bluffing to try to get the State to scrap its sale plans.

However, if the State doesn't scrap its plans and moves forward, do the citizens of Costa Mesa want to get the City involved in a lawsuit with the State (and/or possible purchasers) that may prove costly to defend and which will more than likely send the City into bankruptcy if we lose?

Depending on how the facts develop, here's just one possible tort cause of action that the State could bring against the City (we may list other possible causes of action later):

INTENTIONAL INTERFERENCE WITH PROSPECTIVE ECONOMIC ADVANTAGE

The elements of this tort are: (1) an economic relationship between [the plaintiff and some third person] containing the probability of future economic benefit to the [plaintiff], (2) knowledge by the defendant of the existence of the relationship, (3) intentional acts on the part of the defendant designed to disrupt the relationship, (4) actual disruption of the relationship, [and] (5) damages to the plaintiff proximately caused by the acts of the defendant.' (Buckaloo v. Johnson (1975) 14 Cal.3d 815, 827.)

QUICK UPDATE ON MEETING ON FAIRGROUNDS (More later)

Every seat in City Hall chambers was taken. About 25 people were outside watching on TV screens. Several TV news crews were there and filming the event.

Assemblyman Solorio took the lead and Tran took a secondary position. Both, thankfully, kept their remarks short and quickly started having people from the State, the City and the Public comment.

OC Treasurer-Tax Collector, Chriss Street, spoke and had a chart on what it would cost to finance a purchase should the City or County want to buy the site. (More later on this)

Mr. Street's most important comments were about how bad the economy is and he said that as bad as things are now in Sacramento, they're expected to be much worse next year and the year after that.

Nothing really new was said, however, it appears that the State and Costa Mesa are heading for a legal brouhaha.

Costa Mesa threw down the gauntlet right in front of some executives from the California Department of General Services, who were at the meeting and who spoke briefly, when Costa Mesa's Acting Development Services Director, Kim Brandt, said that while Costa Mesa has limited land use authority over the Fairgrounds while the State owns it; once the escrow closes and a new owner takes over, the City will have greater land use authority.

In plain English: What Ms. Brandt was saying was that if the State sells the Fairgrounds; a buyer is going to find that all he can do with the land is keep it as a Fairgrounds.

Everything is moving very fast on the sale of the Fairgrounds. Here's the time line mentioned at the meeting today: Jan 8th--all bids to be in. Jan 14th--winning bid to be accepted. Jan 21st-- purchase and sale agreement to be signed. March--escrow closes and new owner takes over.

Part of the deal, however, is that no matter who buys the property, the Fair will go on in 2010 at the Fairgrounds.

PUBLIC MEETING THIS AM ABOUT SALE OF FAIRGROUNDS
There's a public meeting this morning at Costa Mesa City Hall with Assemblymen Van Tran and Jose Solorio to get community input on the proposed sale of the Fairgrounds. The meeting starts at 9 a.m. The public is invited.

Tran is there since he represents Costa Mesa in the State Assembly. Solorio represents Santa Ana, Anaheim and Garden Grove, but he may be there because he's on the Appropriations Committee...or, maybe he's just trying to widen his political footprint.

Tran is termed out of the Assembly next year, and it's his seat that Allan Mansoor wants. So far, Tran has not endorsed Mansoor, and some folks believe that he's going to endorse a Vietnamese candidate to try to keep the seat in Vietnamese hands. Racism?
