Expect a legal fight over the Planning Commission's denial last night of a minor CUP to a Solid Landings rehab facility at 657 W. 19th Street.
Previously, the Zoning Administrator had approved a minor CUP on parking for the facility. This was then appealed by a citizen. And, it was this appeal that was heard last night by the Planning Commission.
However, rather than limiting the appeal to the narrow issue of the CUP on parking that was before the commission, the commissioners allowed and heard a wide ranging emotional parade of horribles from the citizen who was appealing the CUP approval and a couple of her friends that barely touched on the parking issue that was before the commission.
While a couple of the commissioners tried, before voting, to cover their denial of the minor CUP by stretching to bring the parking issue back up, this was a very thin and transparent attempt at cover and it might be argued that the commissioners voted based on emotionalism and mob rule (there was lots of noise from the audience in favor of denial) rather than on law. Indeed, the attempt to refocus on parking before the vote was a fig leaf that didn't really cover or hide anything.
Expect Solid Landings to file an appeal with the City Council and also to seek injunctive relief. If the City Council also refuses the minor CUP, expect a huge legal fight and expect the city to lose.
In the end, this will be seen as a Pyrrhic victory against rehab facilities and this victory last night may end up not only costing the city (that's us) a lot of money, but we may actually end up with more rehab facilities than would have been the case had the Planning Commission not denied the minor CUP last night.
Expect Solid Landings to argue, in part, that this denial was unusual and that they were singled out because they are a rehab facility and that other businesses were granted minor CUPs
under similar circumstances.
It appears to the CM PRESS that Solid Landings is on solid ground. And, while many citizens are upset at the number of rehab facilities that are opening in Costa Mesa, the City has to be careful to not discriminate against them and treat them fairly, as the law demands.
Now, as to the laws that allow the opening of so many rehab facilities--well, that's another issue and has to be handled legislatively. If the laws have a bad effect, then the laws need to be changed.

Long column on a liberal Website that seems to have a hard time getting to the point that a group of non-Asian veterans weren't allowed into a meeting about a proposed cemetery for veterans in Irvine.
Was this racial discrimination? Well, one could probably expect the Website writing about this to not have been treating this subject so gingerly had this been a White group holding the meeting and had the White group not let in non-White vets.
