COURT MAY RULE TODAY ON CHARTER ON JUNE BALLOT OR NOT

One never wants to try to outguess how the court will rule, however, we think there's a high probability that the charter will go on the June ballot.
Here's why. Just from the little we've read about this situation, we think a reasonable argument for the good faith screw-up has been put forward, i.e. a miscommunication between the Registrar of Voters and Costa Mesa's City Clerk in which the latter believed that because a portion of the charter deadline was extended, that the whole deadline was extended.
Had there not been that extension, the City Clerk probably would have filed on time. But, had she not, then the court would more than likely rule that it wouldn't go on the June ballot.
Key words are "extension," "miscommunication," "good faith" and "reasonable."
We'll just have to wait and see how the court actually rules. We'll let you know how it turns out.

THE SKY IS FALLING IN COSTA MESA AGAIN!!!!!!!!!Yawn.
The shrill, neurotic Chicken Littles are at it again. It seems the City Council may decide to move the Nuts at Night, er, Public Comments section of the City Council meetings to the end of the agenda instead of at the start.
In the above linked Daily Pilot story about this latest apocalyptic move (to hear the Chicken Littles speak of it) by the City Council, you'll see the same half-wits whining about how this is an attack on their First Amendment rights. Actually, it isn't. Public Comments at the start, in the middle, at the end, or at any other time during the meeting, preserves First Amendment rights in a reasonable, time, place and manner way.
Now, if the Council put in a rule that these nutcakes who are whining about the change had to go give their comments at three in the morning, while standing on their heads, on the top of a tree in Fairview Park, well that would be a violation.

City of Costa Mesa seems to have a problem wih misccomunication with other agencies, with their residents and even with each other. Gteit right for once..missed deadline...didnt follow rules,,,so sad, too bad...November election more time for residents to get info about charter...why the hurry? Exccept the fear residents will figure out the charter only benefits the present council, who cares little about Costa Mesa and its residents.
ReplyDeleteI applaud the idea of moving public comments. I have been an advocate of doing that for some time now. Make it less convenient. For far too long it has been too easy for the same folks to say basically the same things over and over. Their tactic has been to wear the council down so that adjourning after midnight has become common place. I also think making important decisions require alert minds and at 2:00 AM most people are tired.
ReplyDeleteFinally, I am so tired of watching the abuse spewed toward council by the same group. The council very politely thanks each person even if they are disrespectful. Then you read the opposite in the media about how disrespectful council is. Such nonsense. Just for once I wish council would tell the abuser to go to hell.
Oh, one more thing, yes I love Kool-Aid. I am drinking a glass if this gets published.
Kool-Aid Lover, you took your words right out of my mouth! It's beginning to look like the only people in Costa Mesa who are anti-council are union members, union groupies, and their relatives. That crowd is in it for the money while the rest of us are just trying to make ends meet.
DeleteLike you, I am sick and tired of having to watch the same village idiots trying to take control of every city council meeting via Public Comments. Nobody elected them. We don't want to have to hear what they have to say (let them write a letter). The rest of us want to watch the elected officials, not a pack of feeble minded nitwits craving TV time.
Incidentally, Mrs. Egan was beside herself today when she couldn't immediately see herself on the Internet playback of last night's council meeting. When she found out it wasn't working yet, ........ she had a fit.
