SO WHAT COMES NEXT IN THE R&M LAWSUIT?

The defendants must answer the complaint.  This is usually done with formulaic denials of every cause of action. There may also be some motions such as a request for dismissal, or severance.

After that, there will be tons of papers going back and forth--interrogatories, etc. Most under oath with the penalty of perjury hanging over them. Then come the depositions. 

Through all of this, each side gets to see their own strengths and weaknesses and the strengths and weaknesses of the other side.

You're going to be hearing about attorney/client privileges being invoked and much, much more.

It'll be interesting to see who represents the POA.

The Pot Bellied Pigs are all making their usual tiny brain grunting sounds in the local press over the lawsuit filed by Mayor Righeimer and Mayor Pro Tem Mensinger.

Most of the comments are the usual know nothing crap that you hear from these punks all the time.

These creeps want voters to think that they're just apolitical concerned citizens who are soooo concerned about local government and the condition of our city. In fact, however, most are extremist lefties, many are Democrat Party operatives, and the few who start every sentence with "I'm a Republican, but..." are crackpot liberals.

What almost all of them hate is change and smaller, less intrusive government that doesn't keep raising taxes and fees.  And, it is change and smaller, less intrusive government  that lives within its means that the good council members are bringing to Costa Mesa along with an improvement of our infrastructure to attract more upwardly mobile young families instead of people who need charity handouts.

The reality of THE lawsuit

Put yourself in the shoes of Jim Righeimer. 

 Before he was even elected, some rogue cops were out to get him and were using the gravitas inherent in their jobs to try to smear him and  get some easily manipulated ditz-head puppets elected to the City Council to keep buttering their bread while mouthing the usual cliches about how we need more public safety and how, boys and girls, we have the bestest police officers in the whole wide world.

Then, after Righeimer is elected, a private gumshoe who works for the law firm used by the police union--a guy with many prior years of being an actual cop, and who knows his way around--and, who, presumably, has many friends in many police departments--calls in a bogus DUI report on him.

If you were Righeimer, wouldn't you be concerned that there are other attempts by rogue cops to get you and to stop you from voting your conscience on the city council?  Wouldn't you want to stop it?

Exactly what would you do to stop it so you could simply do the job you were elected to do without fearfully looking over your shoulder every minute and not worrying all the time that if you vote on the council in a way that the union doesn't like, that you may piss off some rogue cops who will stalk you either directly or through third persons?

Would you roll over and give the rogue cops everything they want?  That would stop the attacks on you, and that's what many previous city council members have done.  They've just gone along to get along.  They smiled, scratched their butts and rubber stamped all sorts of pay increases and benefit packages that have now got the city owing many millions of dollars in unpaid liabilities.

But, if you're Jim Righeimer,  you know that you were elected, that you took an oath, and you have a fiduciary responsibility to the citizens of Costa Mesa--not to the rogue cops who mostly don't even live in Costa Mesa but who are paid so well that they can live in cities such as Newport Beach.

You know, folks, there's a reason we have our judges put on black robes when they sit on the bench.  It is a reminder to the public and to the judges themselves, that when they are wearing that robe they are putting aside their personal interests and that they are going to be fair and do what is right no matter their politics.

We don't have our city council members don black robs, but some do take their oaths seriously and some do have ethics and some do want to do what is right for the citizens of this city.  When some people take the oath of office, they mean it.  They don't roll over.  We think Jim Righeimer and Steve Mensinger are like that.

We could name another politician who is not like that.  She's a uniform groupie who lies to herself and to the people of this city as she twists herself into a pretzel to justify things that are not in the best interests of the citizens of this city.  But, we won't name her here.  It would just be a distraction.


In every bushel there are good apples and a few bad apples. It is the bad apples that we don't need in Costa Mesa.  We don't need cops who want to play politics in this city where most of them don't live and where they can't even vote.  If they want to play politics, they should do so in the cities where they actually live and where they have their families and their hearts.

Bad cops give good cops a bad name.

Oh, and lest you think we're writing this because we're pals with Righeimer and Mensinger, it just isn't so. We've never been to their houses and they've never been to ours.  We've never sat down and had a coffee with either one or broken bread with them.  We really do try to keep an arm's length distance from elected officials, largely so we won't feel constrained in criticizing them if we feel it's appropriate.

And, in case you don't remember, we even opposed Righeimer the first time he ran for the council  in Costa Mesa because we felt he hadn't been here long enough to be acculturated into our local scene.


Furthermore, if some of you think that I just don't like cops, you're mistaken.  Some of you probably know that I'm an ex-Marine and some of you probably also know that of all the military services, Marines generally tilt more toward law enforcement than the others and that's why so many ex-Marines become cops.  It's in their/our/my nature. We are born that way.

But, it's also in their/our/my nature to stand up for what we believe is right--without compromise--and to not roll over just to get along. Call it old fashioned, but that's how some of us are.

Ever since we started the CM PRESS many years ago, we have been guided by a simple principle in regards to Costa Mesa:  If it will improve Costa Mesa, we are for it.  If it will harm Costa Mesa, we are against it.  If it will do neither, we are neutral.  That has never changed.

And, we think, on balance, that Jim Righeimer and Steve Mensinger (and also Gary Monahan, who seems to agree with many of the improvements that R&M are bringing in) are doing what needs to be done to improve Costa Mesa.

No, we don't agree with all of their priorities and everything that they're doing and you've read about those right here many times before, but when we think about such things, it's a little like putting weights on a balance scale. So far, the balance scale has tipped much more for what R&M are doing than the other way.

BE SURE TO READ ALL THE COMMENTS FROM KARIN AHLF [HERE] ABOUT THE R&M LAWSUIT

Ahlf seems to have a hard time understanding that there is really very little difference between unions and associations, so she keeps repeating the same things over and over.

And, in the larger scheme of things, it doesn't make any real difference what they're called as far as the R&M lawsuit goes.

Ahlf is a constant critic of the good Council members and can always be counted on to write a few things after almost every story and to give attaboys to the small group of others who do the same thing. It's almost as though she's a cheer leader and is trying to encourage others to write more comments.

Along with Ahlf, we see the same few names time after time on comments knocking the good Council members. It's as though these few think that  if they write constant comments, that readers won't realize that you can usually count these people on one hand and most of them are saying very little, if anything at all.

When filing a lawsuit like this one against those with deep pockets, it's important that you use a law firm that also has deep pockets. The depositions alone will run into the many thousands of dollars. It sounds like the firm being used by R&M: Manley, Stewart and Finaldi is up to it.

We haven't seen the lawsuit, but in a case this big, we would expect to see anywhere from 35 to more than 100 John Does also listed; whose real names will be filled in as the suit progresses through discovery.  So expect more names to be added.

Mayor Pro Tem Mensinger tackles a previous goofy column by a guy named Mooney in which Mooney essentially tells us to look under our beds, boys and girls, because Bell may be there. Sigh.

Folks, Mensinger has it right and Mooney has it wrong.

What Mooney did was make a false cause argument that posits the notion that  because Bell is a charter city and it had some crooks at the top, that it is the charter that is the sine qua non of the problems in Bell.

In fact, as we've pointed out before, the problems in Bell were caused because it has a huge population of illegal aliens who simply don't want to call attention to themselves and who thus don't want to bring their unclean hands to look over the shoulders of government officials.

But, using Mooney's argument we might as easily say that Irvine and Newport Beach are such top rated cities because they are also charter cities.  But, of course, that would also be a false cause argument. N'est-ce pas?

PROPER PROPORTIONS IN ALL THINGS

Top recipes are the ones that have all the elements in proper proportions.

It works that way for businesses, cities, and the governments of cities also.

As far as businesses go, there are tables available for all businesses telling the owners how much they should spend on labor, how much on parts, how much on advertising, how much on rent, how much on utilities, etc.

The tables are different for different businesses.  There are also tables for governments. These tables can tell those in charge if something is out of whack and needs to be looked into and perhaps corrected or at least explained.

We  believe that Costa Mesa is out of whack in some areas. Most concerned citizens know, for example,  that our  60 per cent renters vs. 40 per cent homeowners ratio is upside down. That's a proportion that the city should be trying to fix.   We need to cut back on the renters by a couple of tablespoons and increase homeowners by half a cup.

But what about the people who work for the city?  Do we have too many in this area, and too few in this other area?  Do we pay too much?  Do we have too many executives?  We think these and many similar questions should be answered clearly with standard tables as the guide and that we should compare our vital statistics with cities similarly situated.

Actually, at least some of the above is being done and we've seen reports on this or that part of the city organization, money spent, etc. with comparisons to other cities.  But, we're not aware of any strong calls to action on some of these out of proportion elements from most of our politicians. And, without action, these reports are meaningless.

The CM PRESS has been going to planning commission and city council meetings for a few years, and one of the things we try to do when we go to these meetings is to encourage single family home building to replace some of our functionally obsolete apartment buildings.  We'd like to see the planning commission and the city council do more in this area.  And, we'd like to see them stop approving under parked apartment buildings that are pushing us further out of whack and which are causing other problems.

We do have to say, however, that we believe the good council members are on the case in their own individual ways even though they may have different priorities than we do.

A recipe for a good city isn't that hard to come up with.  You just need the proper proportions of the ingredients that make a good city a good city.

Some of these lefty jerks like to start every sentence with "I'm a Republican, but...." Yawn.  Bunch of phony lefties. They usually follow that "but" with calls for higher taxes and fees, more government, higher wages for city employees and less improvement of our infrastructure.  Why do they want to raise taxes on businesses?  Just because they can.

But I digress.  Anyway, how about using the Pot Bellied Pig as their symbol?  They can just call themselves Pigs for short and since it's only four letters, many of them will be able to spell it.

Really?"   No, not really.  The mayor didn't write anything about a return to reason,he just mentioned the word reason in a throw-away comment deep in his column.  That was the name of a defunct group of lefties from the last election who have now come back under a different name.  What the mayor wrote was pointing out as his mahjor point (it's in the headline and in the body of his column) that we need to return to "normal."

The third comment as of this writing is from Karin Ahlf who writes that Costa Mesa doesn't have unions.  No, you see, boys and girls, Ms. Ahlf wants you to know that the employees belong to associations. Sigh.

Be sure to read the full comments from the above three and the others that will no doubt  appear shortly from the same crowd, and decide for yourself whether Mayor Righeimer makes more sense than these people.  In our opinion he does. He presents the facts and gets right to the heart of the matter.

To keep things in perspective make sure you do read the mayor's full column (it's short) and then weigh his reasoned arguments against the emotional fact free nonsense and name calling  that the lefties write to try to confuse voters.

ANOTHER ARTICLE ON THE DISCOVERY OF THE OLINGUITO

What's missed in most articles about the discovery of this new species, including the one above, are the underlying truths of nature and evolution that organisms constantly change as natural selection and the other basic forces of evolution change them to be more efficient in any given environmental niche or so they can survive and thrive in a new niche or a segment of the niche.

Thus, it appears that the Olinguito which was, up until this discovery, thought to be an Olingo appears to be a branching off from the Olingos.  And, it has now also been discovered that there are actually four subspecies of Olinguitos.

Subspecies are members of the species that are also starting to branch off.

The way it works is that a small group of any type of organism will be isolated from the main body of that type of organism and then with mutations and differing environmental pressures they will begin changing a little at a time, and if the changes give them a survival advantage, the changes will spread through the population and the population will head toward full specieshood.

On a DNA level the changes will often seem very minor.  However, it's a little like firing a rifle.  A minor flinch at the trigger will send the bullet many feet or yards away from the target.

So, with the split between Olinguitos and Olingos, one might speculate that some smaller, lighter weight Olingos found safety in the tree tops while their larger relatives stayed lower down and that over time the smaller Olinguitos adapted to the higher smaller branches and the fruits and insects they found at those heights and that their lighter weight and other factors gave them a survival advantage in that niche.  And, as time went on, other mutations appeared and eventually their ability to reproduce with the Olingos disappeared.

Hey, Obama, it was a military coup. Cut off aid to the Egyptian military and gain some respect for the US, and show the world that we obey our own laws.

Some of the hypocrites (such as Rush Limbaugh) are saying that since the "people of Egypt" didn't want the Morsi government it was okay for the military to stage a coup.  This is nonsense.

Yes, lots of Egyptians didn't vote for Morsi, but they lost the election.  Following Limbaugh's logic, one might argue that since millions of Americans didn't vote for Obama, that it's okay if our military stages a coup.

When you push for democracy, you have to accept the will of the voters.  You don't just send in the military if you don't like the election outcome.

BLACK MALE IDENTIFIED AS THE SUSPECT IN TWO CM BURGLARIES AND SEXUAL ASSAULTS
[Below is the CMPD Press Release as received by the CM PRESS]

[UPDATE: The OC REGISTER has a photo of the punk.  He committed his crimes in the north part of Costa Mesa, so maybe some of you folks in that area will recognize him--and, maybe help solve some other burglaries in the neighborhood.]

Thomas Walker, age 46, identified as the suspect sought in connection with two, early 2013, Costa Mesa residential burglaries involving sexual assaults of women in each case.
On January 27, 2013, at approximately 1:00 a.m., an unknown male entered an apartment on Mendoza Drive near Mission Drive, through an unlocked sliding glass door. The suspect attempted to sexually assault a 32 year old female victim before being scared off.
On February 13, 2013, at approximately 9:30 p.m., a subject described as an unknown male Black entered an apartment on Valencia Street near La Salle Avenue. No indication of forced entry was apparent, and the suspect may have possibly entered through a window. He confronted an 18 year old female victim in the bathroom, threatened her with a small knife, cautioning her not to yell out. The suspect sexually assaulted this victim and fled on foot through a window.
Approximately four hours later, a Police Department Crime Scene Investigator working in the area observed the possible suspect in an alley near the area of Mission and La Salle. Upon seeing the police employee, the subject immediately ran from the area while being chased by local residents. A search of the area was conducted with negative results.
On February 27, 2013, a subject by the name of Thomas Walker was arrested by the Santa Ana Police Department and subsequently charged with burglary and drug related charges. He was transported to the Orange County Jail where he remains today.
Thomas Walker, a transient with a lengthy criminal background, has been identified by Costa Mesa detectives as the suspect in the two sexual assaults listed above. Additionally, Walker was on Post Release Community Supervision (PRCS) as part of AB109 Realignment at the time these incidents occurred.
Costa Mesa Detectives presented both cases to the Orange County District Attorney’s Office, requesting charges be filed including burglary, assault with intent to commit rape, forced oral copulation, and false imprisonment.
There is no additional information for release.

FORMER CMPD COP WRITES A LONG COMMENT IN THE DAILY PILOT 

For some reason, Allen Huggins, who is a retired CMPD cop, who apparently now lives in far away Idaho, felt it necessary to give his two cents worth of opinion on the biased Daily Pilot article on CMPD hiring.

There's not much substance in Huggins' comments.

If you read them, you'll see paragraph after paragraph of surplusage that says very little.  Naturally, some of the lefty dimwits will see all the words and think there must be something important there, when the opposite is the case. "Where's the beef," comes to mind.

It appears to us that Huggins' major complaint  revolves around rhetoric (a word that Huggins uses often), from the good Councilmembers, including the use of the term "union thugs," and this, according to Huggins, demonstrates divisive leadership and scares good applicants away from applying to the CMPD.

Actually, and this is right in the Daily Pilot article that Huggins is commenting on, there are plenty of applicants--in the many hundreds, in fact. Thankfully, however, the CMPD has set the bar high and is looking for good officers.  This may not always have been the case is the past.  We are reminded of the CMPD cop  who was stalking a woman by using a CMPD tracking device, and other incidents.

But, what about the good Councilmembers using the term "union thugs"?  What would Huggins call people who send in private detectives to follow Councilmembers?  And, what would he call someone who claims a Councilmember is driving under the influence, when he wasn't?  And, what would he call cops who run to the newspaper (anonymously) to make it seem that a politician was a raving wild man after the politician simply and very politely questioned the placement of a DUI checkpoint where it was backing traffic up on to a freeway off ramp? And, what would he call union members who drag a big anti-Righeimer sign around the city, in order to try to stop the election of someone who partly campaigned on fiscal sense in this city, so one of the usual puppet politicians (who roll over and give away the farm), could be elected instead?

If there is divisiveness in Costa Mesa's governance, it is being fanned by a small clique of lefties who would find fault with the good Councilmembers even saying "Good morning."  In other words, it's politics and nothing more.

And, in this regard, you'll note that many of the usual lefties have now started a Democrat Club.  Yes, many of these people are the same ones who whine and complain about the good Councilmembers all the time. They are not just unbiased, apolitical concerned citizens. They want a big spending lefty Democrat City Council. Even the ones who claim to be Republicans who are in this clique are really Republicans in Name Only and are usually kooky lefties who really support Democrats and Democrat ideas of big, all intrusive government and higher taxes and fees.

And, these are the same lefties who want taxes and fees raised in Costa Mesa.  Is that what most Costa Mesan's want?  We don't think so.
