At tonight's City Council meeting, the Council will vote on putting in additional parking and other "improvements" Item 8a [HERE]--"Fairview Park Entry Concept Plans."  The CM PRESS opposes this completely.

There are those in our city who feel that we must pave over or change every natural piece of ground we have in this city.  We disagree.  We believe that we have plenty of parks where this crowd can go and put in plastic flowers and plants to their heart's content.

How about just leaving Fairview Park open and free to the forces of nature and to the wind sown plants that are now natural there?

We do not need to turn Fairview Park into an overly manicured Japanese garden.

We do not need more asphalt trails.  We do not need more parking.  We do not need more lights.  We do not need turnarounds.

Leave the park alone.  Let it be truly natural.  Let the park evolve naturally.

These guys are both great heavyweights.  If we had our way, both would win.  But, of course, that's not the way it works.

We think Klitschko will win on points--or it may be a split decision/ We think Klitschko will try to keep the shorter Povetkin off him with his long jab. Povetkin has to try to get inside, but Klitschko's jab isn't a pitty pat and he often keeps one hand low that can come up with a devastating upper cut.

HERE'S a look at Povetkin in action against a number of different opponents.  Notice that Povetkin mostly uses hooks to knock out his opponents and he's hitting them on the side of the head below the ear. Now, what have we told you about this technique and who it works against? Right. So, hooks aren't good choices against Klitschko.

You don't ever want to let Povetkin get you against the ropes.  If he gets you there, all you're going to see and feel are powerful punches coming at you in a blur.  Povetkin has power in both hands and can knock you out with either one.

Klitschko is 6'6" tall and has a reach of 81 inches.

Povetkin is 6'2" tall and has a reach of 75 inches.

It also means that one is biased in a certain way.

The tiny brain herd is about hating the good Council members and  it has a leftist, big intrusive government ideology.  That's their partisanship.  They are  partisans for these views and they are in a minority in Costa Mesa.

Some in the tiny brain herd claim to be Republicans, but these are mostly far leftists who try to give cover to the other leftists by being registered as  Republicans.  They side with the most radical elements of the Democrat party against smaller, lesser intrusive government.

So, the tiny brain herd is partisan, by definition.  It is not non-partisan.  

Also, if you doubt they're in a miniority just check the comments under almost every article in the Daily Pilot. It's always the same dopey few who comment and most of their comments are just attacks on the good Council members and are devoid of any substance.

At its regularly scheduled meeting next Tuesday (9/17), the City Council will look at a screening request for 20 more live/work units proposed for the now empty corner  lot at 1695 Superior Ave. (SWC of 17th Street, catty-corner to Trader Joes).

[Trivia:  This is the stink-eye lot where former  Council member Bever and a friend said some Costa Mesa cops came by and photographed them putting up signs and generally made them feel uncomfortable.]

The "work" portion of each unit is smaller than a two car garage.

As we've written before, we'd like to see the Council encourage some Work/Live units in which the work portion of each unit is much larger than in Live/Work.  

How about it City Council?  Some Work/Live units might be a welcome addition to all the Live/Work units coming down the pipe line.

UNION MAKES A BAD COUNTER PROPOSAL

The union wants workers to get a 1% raise each year if the City's general fund increases by 2%.

This is crap.

It's like a profit sharing plan or a percentage lease in a shopping center and it makes no sense in this context.

What will happen if this is accepted by the city is that workers will then whine that we need more taxes and fees on citizens and businesses to increase the general fund--so they can make more money.

Then, the workers will try to elect puppets to the City Council who will go along with raising taxes and fees and who will screw the citizens and businesses of Costa Mesa (as many Council members have done in the past) in order to get the election support of the unions.

We'll also hear more grade school level propaganda from the ditz headed union puppets on the City Council who will say things like:

 "We're Costa Mesans and we support our city employees who are the bestest empolyees in the whole wide world.  Why, they're part of our family."

Hey, city employees, you're employees of the citizens of this city.  You are not our partners.  You are not our bosses.  You are not our family.  You work for us. You do not get to tell us that we must tax ourselves more and find more revenue with phony code enforcement tickets and other fund raising schemes, so you can make more money.

We get to call the shots on what you earn through our elected representatives.  If you don't like it, go work someplace else.  We'll miss you, but we can easily find other workers who will do what you're doing and who will be pleased to get the jobs and who will thank us for letting them make a nice living here.

Genes are us, and so-called free will is much overrated.

The person you see in the mirror is the product of your unique DNA code (you might prefer the terms recipe or blueprint) and that DNA code "wants" to survive.  You are the means to its ends.

Unfortunately, in writing about the DNA code in this way, some might misunderstand and believe that the DNA code is like a tiny being inside of us.  That's not the case.  It is one with us.  It makes us, us. It is us, and we are it.

Every organism on earth that we know about (with the possible exception of some viruses which rely on RNA rather than DNA), have a DNA code that is at least unique to their particular type of organism, and in humans and other organisms that reproduce in our manner, it is, in addition, also unique to us as individuals.

DAILY PILOT:  POLICE MAKE ARREST OF MURDER SUSPECT

We also received a press release from the CMPD on this arrest, but there aren't many addtional details such as the race of the suspect and victim.

However, there is a business in Costa Mesa that reportedly employees around 40 people that is headed by a man with a name similar to that of the victim, John Gerard Kubat, 54.

If the CMPD releases a photo of the suspect, only described as a 35-year-old transient named Christopher Ernest Leovy, from Los Angeles, we'll try to publish it.

Be sure to read the selective outrage from the usual small handful of liberals in the Daily Pilot [HERE], over the fact that someone apparently tried to make a long used path safe for kids, and compare their lack of outrage when a fellow liberal actually wrote a column in the Daily Pilot about how he was shooting at an endangered species with a sling shot.

SHOOTING AT CROWS WITH A SLINGSHOT 

As you will see in the above linked Daily Pilot column written by Tom Egan; Egan admits to using a weapon*--a slingshot--within Costa Mesa city limits against crows who bother him. 

A Crow

Egan's property backs right up to the Westside bluffs, so the crows  are more than likely coming in from the wild open area and nature preserve that is all along the bluffs and which blends into Fairview Park.

In his column, Egan finally says that his tree has now died, and one commenter suggests that it may have died because Egan chased away the crows that might have been eating the beetles that may have been eating Egan's tree.

Some wags might even ask if  Egan violated the following Costa Mesa Municipal code section:

It is hereby declared unlawful for any person, other than a peace officer acting in his official line of duty, to shoot, fire or discharge, or for any person to cause or permit to be shot, fired or discharged within the corporate limits of the city, any rifle, shotgun, pistol, revolver or other firearm, or any air gun, air pistol or air rifle, or any other weapon which emits a projectile as a result of pressure exerted at the breech, except when it may be necessary to do so to protect life or property, or to destroy or kill any predatory or dangerous animal, unless said person shall have first obtained permission in writing to do so from the chief of police

Egan may now try to argue that he was protecting his property from the crows, but in his column he says he was shooting at them because they were making noise.  That's not the same thing as protecting one's property. Furthermore, American crows (Corvus brachyrhynchos) are protected by law, as you will read below.

Was this federal law violated?

The Migratory Bird Treaty Act of 1918 (MBTA), codified at 16 U.S.C. §§ 703–712 (although §709 is omitted), is a United States federal law, at first enacted in 1916 in order to implement the convention for the protection of migratory birds between the United States and Great Britain (acting on behalf of Canada^[1]). The statute makes it unlawful to pursue, hunt, take, capture, kill or sell birds listed therein ("migratory birds"). The statute does not discriminate between live or dead birds and also grants full protection to any bird parts including feathers, eggs and nests. Over 800 species are currently on the list. [Including American crows--Corvus brachyrhynchos]
Egan also suggests that the crows weren't hurt by his shooting at them with his slingshot, because he says the projectiles just bounced right off the crows.  So, he admits that he hit them with the projectiles.  He also admits that the crows fled after being shot. That would indicate that the crows didn't think being shot at was something to be ignored.  And, of course, it wasn't Egan who was being shot at.  Perhaps if someone was shooting at Egan with a slingshot he might have a different view of whether it's harmful or not.

Also, Egan admits that after a few shooting sessions, the crows would leave just at the sight of Egan with the slingshot in his hand.  This speaks to the intelligence of the crows, and as you may know, crows are one of the most intelligent of birds, and the American crow is actually a tool user.

*Dangerous Weapon--Definition--Any object, such as a gun, knife, sword, crossbow, or slingshot, that is intrinsically capable of causing serious bodily harm to another person. The definition becomes important in cases where criminal laws attach particular consequences to crimes performed with a dangerous weapon.

OMG, FFNP & DG IN THE DP!   REWARD OFFERED FOR THOSE WHO TRIED TO KEEP HUMAN KIDS SAFE!

We imagine:  Kids walking to school over a long used path trip and hurt themselves in a slight indentation in the ground called a vernal pool.  The kids didn't know it was a pool because, well, there's no water there. But anyway, to head off kids falling into the pool with no water that just looks like a slight indentation in the dirt, responsible people mow the trail and put down some organic material to keep the kids from hurting themselves on what amounts to a prescriptive easement.

But, lo and behold, there's a vernal pool there that doesn't look like a pool because, again, it's just dry dirt.

And, the inhabitants of that pool, that isn't a pool right now, the fairy shrimp, aren't talking--that's because they're just tiny little eggs buried in the dry dirt right now and can remain that way for years.

So, there are no tiny voices yelling out in their poor English, almost as though they are lefties: "Hey, who ya callin' a shrimp?"   And, "This dirt don't look like no pond to you, ah, because there's no water here, but sometimes there's water here and we're more important than the safety of kids, so don't do nuthin'  near this here undefined dirt area with no borders that don't look nuthin' like a pond or a pool; which, if it did, might put people on constructive notice that that this here dirt is different from that identical lookin' dirt over there. Ya see, some years our pool is bigger than other years depending on the rain fall.  And, you just gotta guess where our pool ends when there's no water around."

PUTIN WRITES A NICE OP-ED IN THE NEW YORK TIMES

Takes issue with some dimwit conservatives who tout  American "exceptionalism."

This false belief in American exceptionalism is akin to supremacist thinking in which those who believe they are above others then believe that they must be the Great White Mothers and Great White Fathers and interfere in the internal affairs of other nations.

And, Putin has it right.  This is dangerous thinking. We have the U.N. to try to prevent more wars, but the U.S. refuses to play fair with the U.N.

If the U.N. says something we like, then we praise it.

 If the U.S. says something we don't like, we smear it and do what we want to do no matter what the U.N. says.

The U.S. should stop being the major buttinsky around the planet.  It is not for us to tell other peoples how they should live or what they should believe.  When other nations have civil wars, butt out America, let the people in those nations sort it out.

DAILY PILOT ARTICLE ON SMALL LOT DEVELOPMENT PROPOSAL

And, we get  misunderstood by 180 degrees.  We talk fast, and there was noise in the room, so this can happen.

The Pilot story has this:
"Mesa North resident Martin H. Millard said the small-lot developments should be replacing the Westside's "functionally obsolete buildings" with better ones and not just aiding the Eastside."

What we meant to convey:
We do not see this ordinance as aiding the Eastside, but harming it.

This ordinance should be used where we have functionally obsolete apartments: on the Westside, Mesa North and Mesa del Mar, and it should not be used on the Eastside to further crowd that area. 

And, the ordinance should not be rolled out city wide but just in the areas mentioned above where it can be used to reverse the downward spiral caused by slum conditions.  To be clear.  We do not see this as a plus for the Eastside as the Pilot quote seems to indicate.

NEW POLL SHOWS REPUBLICANS VEERING TOWARD LIBERTARIANISM

Years ago, when I was acting in New York City, I was also one of the original five or so members of a very early libertarian group called the Society for Individual Liberty.  This group existed before the present Libertarian Party was established.

Much of libertarian thought is based on the principles of individual liberty and smaller, less intrusive government. However, some libertarians push for open borders, and this is something that many of us who do have a libertarian streak oppose.  And, those of us who do oppose it have more of a particularist world view rather than a universalist one.

SMALL LOT ORDINANCE MEETING

We attended yesterday's  joint City Council/Planning Commission meeting on a proposed small lot ordinance for the city.

At our two minute fast talking time at the mic for public comments we said several things that we hope those behind the ordinance will think about:

1. This ordinance should probably not be rolled out city wide.  If it is, what will happen is that developers will continue to gobble up lots on the Eastside and make that area even more crowded and full of cars and traffic than it already is.  In fact, and we told the group this, it wouldn't surprise us if we soon hear that a bunch of properties on the Eastside are already being held in silent escrows just waiting for this ordinance to pass, and once it does they'll flow out like crazy.

2. Expanding on our first suggestion above, we then said that it might be better if this ordinance is rolled out in selected overlay neighborhoods, such as parts of the Westside, Mesa North and Mesa del Mar, which have many functionally obsolete apartments, so developers will be herded in those directions.  And, as part of this suggestion we said that additional incentives (no parking variances, please) should be offered so  developers can afford to buy up some of these functionally obsolete apartments, assemble parcels, put in small lot developments of detached single family homes, and still make a profit

3. We know the ordinance doesn't change parking requirements, but we also told the group that they can count on developers coming in and asking for parking variances.  This is what happens all the time now, and these variances are often rubber stamped.  This is leaving large parts of the city woefully underparked. The best written ordinances fail if variances are given out like candy at Halloween.

So, what's it all mean?

The ordinance can be a good tool to improve parts of Costa Mesa or it can be a bad tool if it is used in the wrong parts or if there is mission creep as developers try to get R1 lots rezoned to R2 so they can use this ordinance where it's not supposed to be used.
