Now, if we could only come up with an injection to help the dumbest of the hate filled critics of the good councilmembers be even slightly more intelligent.
Here's the movie:
The hate filled critics, with their dull eyes, their pot bellies, their slack jaws, their flaccid lips, and their maggot like squishy soft flesh, show up at a city council meeting grunting as they start to enter the building. But, as they walk through the door they get an injection. Within minutes, they stand tall, their eyes clear up and they're actually thinking logically. Unfortunately, the injection only lasts for several hours, so at the end of the meeting they turn back into the dullards that is normal for them and they skulk off into the dark grunting once again.

TEMPEST IN A TEAPOT OVER TRAIL IN FAIRVIEW PARK
Apparently, there was a well worn and often used foot trail near the vernal pools in Fairview Park that was used by kids going to school. It was the sort of trail that one often finds across empty lots as people naturally take the shortest distance between two points.
Under California law, when there is an open and notorious use of a trail across real property for at least five years, the user(s) of that trail can claim that a prescriptive easement has been established for his or her benefit or for the benefit of the public, and the use of that trail can continue.
Obviously, there are other fact based issues in the present situation. And, that's why we have lawsuits.
One side might argue that since kids were using the trail and the city knew about it, that if someone was injured on that trail, the city would face a negligence lawsuit. So, the solution would be to either fence off the trail so no one could use it, post it properly, or simply make it safe.
This could go on forever with ping ponging arguments back and forth, but, hopefully, common sense will prevail without lawsuits, and the vernal pools will be made whole and the trail used by kids will in some way be made less intrusive but still safe to use.
A Larger issue
As far as Fairview Park as a whole goes, the CM PRESS has long argued (but few listen) that it should be kept in as natural a state as possible.
A few years ago, the then council started the process of turning the park into a well manicured and artificial garden and some on the council argued that they were restoring the park and replanting it with native plants.
At that time, the CM PRESS argued that the way the park was, was its natural condition and the plants then existing there were the present native plants.
We also pointed out to the council that evolution is all about change and natural selection.
When the council spoke of planting native plants, we wanted to know, in order to make our point about evolution, exactly which "native plants" they wanted to put in. Did the council want to put in native plants from a couple of hundred years ago or a thousand years ago or a million years ago?
Native then, is not native now. Native should mean wind-sown and grows naturally with no help.
All those so-called old native plants have lost the battle of survival to plants that can now survive in our present conditions with no help from man. And, the so-called native plants that the council has now put in require constant life support by expensive staff members who must do nothing else but try to keep them alive.
So, what we have now in Fairview Park is a sort of Disneyland--an artificial park instead of a natural park and there are moves to further screw up the naturalness of the park by putting in all sorts of slick trails so people can walk over every inch of the park from new large parking lots to see the artificially maintained plants and so they can oooh and ahhh over "nature."
