ALMOST DAILY DAILY PILOT HAS ANTI-WHITE PEJORATIVE IN COLUMN
TODAY

John Reger, who writes restaurant reviews for the almost daily Daily Pilot, has this gem in his column today:

"For us gringos smart enough to venture over there [a restaurant on Costa Mesa's Westside], we are treated to the same fantastic Mexican food that the locals get."

Gee, John, there probably aren't as many gringos around these parts as smart as you. Might be a few beaners, slopes, niggers, pollocks, kikes, fags and gooks who are smarter though.


You see, John, members of all those groups are smart enough to rightfully resent being called any of those names. So why, John, do you think it's okay to use a similar offensive pejorative for white people?

You will note that the OC REGISTER had no such compunction against showing a photo or about identifying a white guy by race who was just convicted of murder.

Liberal newspapers do that to make you think that crime is an equal opportunity employer. It's not.

YOU WON'T BE PRIVY TO THE MOST IMPORTANT THING ON NEXT WEEK'S CITY COUNCIL MEETING--THE FAIRGROUNDS

HERE'S the agenda for the 11/3/09 meeting of the Costa Mesa City Council.

The most important item on the agenda is the one below, which is a closed session item (that means the public is barred):

2. Conference with Real Property Negotiators – Property: 88 Fair Drive. Agency Negotiator: Allan Roeder, City Manager. Negotiating parties: State of California, Under negotiation: price, terms of payment. Pursuant to Government Code Section 54956.8

Here's what may be going on. The property at 88 Fair Drive is the Fairgrounds.

Generally, when one government entity wants to sell a government owned property, it usually allows (or has to allow (?)) another interested government entity the first bite at the apple. Sorry, we don't have time to research the law on this, so the above is just from memory and our memory may be wrong; so we offer this as nothing more than a guess. Gov't Code Section 54956.8 is just about giving the negotiator the right to negotiate, so there's not much to wring out of that.

It could be that the City Council is trying to force the State to give the City of Costa Mesa a firm price on the Fairgrounds as a Fairgrounds (which will be many millions of dollars less than the highest and best use price for the Fairgrounds), and also the first bite at the apple. Again, this is just a guess.

If our guess is correct, and if the State sets a firm price based on the Fairgrounds continuing as a Fairgrounds, then the next step would be for the City of Costa Mesa to find a way to finance a purchase. This might be very tough in today's market, and we may be looking at a new Bond measure.

However, don't get your hopes up. We don't think the State would be foolish enough to set a firm price based on a Fairgrounds use. It's simply not the highest and best use of the land.

MORE ABOUT THE COSTA MESA FAIRGROUNDS & SNOOKERING

We thought we had explained a possible scenario about the Fairgrounds in our earlier articles, but we've received a few comments from folks who apparently didn't get it.

So, here it is again in different words.

If you're a developer with a secret plan to build homes, retail stores and maybe an office building or two on the Fairgrounds site, you want to be able to go to the State of California and tell them, that because of the restrictions on the property, you can only pay, say, $30-50 million for it. To do this, you'll want the Costa Mesa City Council to make a lot of noise (right now) about how the City is, in fact, going to put such restrictions on the site.

Then, once you get the site on the cheap, you simply get three people elected to the City Council who will get rid of the restrictions so that you can build as you want.

Frankly, the surest way to keep the Fairgrounds as a Fairgrounds is to have another government entity buy it. The other government entity could be the City of Costa Mesa or the County of Orange or a partnership between them or maybe even with some Newport Beach involvement. On this last point, remember that we do have a joint school district with Newport and this angle could be massaged.

Of course, even having a government entity buy the place is not an absolute guarantee that it will remain a fairgrounds.

One of the problems we have at this time in our history is that the center of gravity of Orange County has switched to the south of us, and an annual Orange County Fair held at the Great Pork is just around the corner no matter what happens with the Costa Mesa Fairgrounds.

So, would we see competing annual fairs? Maybe, but probably not for long. Our guess is that the one held in Costa Mesa would quickly go out of business.

Q. How many Costa Mesa City Councilmembers does it take to change a lightbulb?
A. Three.

Q. How many does it take to change zoning, screw up a city, ruin the Westside, let the airport grow, let the Fairgrounds be developed, put in an IKEA, give your money to charities that welcome illegal aliens and comfort gang members, waste your money on expensive projects, and keep the city full of illegal aliens, gangs and slums?
A. Three.

Now do you understand why the CM PRESS goes to as many City Council meetings as possible?
Now do you understand how local politics works? Count the ways: 1, 2, 3.

All it takes is 3 votes to change the direction of Costa Mesa.

Be sure to read the article right below this one about a slow moving train wreck that is about to hit Costa Mesa that is going to be difficult to stop.

And, if you think the dithering class is on top of this, you'd better remember back to when the same dithering class said they were going to put a commercial airport in El Toro. The joke was on Costa Mesa and Newport Beach citizens as we got snookered.

If you want something done right, you better do it yourself by getting involved.

ORANGE COUNTY FAIRGROUNDS--HOW REAL ESTATE FORTUNES ARE MADE!
(First publshed in slightly different form in CM PRESS # 771, August 4, 2009)

Maybe there really are some folks who want to buy the OC Fairgrounds and keep it as a fairgrounds forever. Well, it's possible. But possibility is not the issue. Probability is.

You see, there have to be some who see it as a chance to make many millions of dollars with very little risk.

Here, by the numbers, is how the gravy train can run for those who want to make a killing in real estate (in simplest terms). Note that the first step can be used both by those who really do want to keep it as a fairgrounds forever and by those who want to make a big profit:

1. Set up a non-profit corporation and buy the fairgrounds as fairgrounds,with fairgrounds zoning--the land is valued much less for such uses than for some other uses--so you'll get it for a song. Tell everyone who will listen that you intend to keep it as fairgrounds forever to help with your charitable causes and to serve Costa Mesa. You especially want to help the kids.

2. Once you own the fairgrounds, land bank it for a couple of years while servicing your debt (at least in part) by intensifying its present fairgrounds uses.

3. Work to elect a friendly Costa Mesa City Council.

4. Once you have a friendly City Council (you only need three of the five to be on board with you) claim that the fairgrounds is not bringing in the money you thought it would and you need a zoning change for a large portion of the land so you can maintain the remaining part as a reduced size fairgrounds in order to continue helping poor children who will all become gang members unless you help them with after school programs, etc.

5. Have your pals on the Costa Mesa City Council vote to change the zoning on a large part of the land to residential, office, retail or even a few institutional uses. (Laugh silently to yourself as you hear your Council stooges talking about Costa Mesa being a city with a heart, and how we have to help the children.)

6. Sell those rezoned parts of the land at the much higher price you'll get with the new zoning. In public, shed [crocodile] tears for the loss of the land but claim that, gee, you need the money to help the poor at risk children. Also say that the new smaller fairgrounds will be much better than the old larger version because you're going to bring in some new activities for children and families.

7. Manipulate public opinion by having your dimwitted surrogates (on the Council, in the blogosphere, and in the local press) claim that those who see what you're doing, and who speak out about it, hate children and especially poor brown children, and that unless you can proceed, these poor brown children will turn to gangs and terrorize the city.

8. Laugh as you go to the bank to count your money.

THE CM PRESS ON HEALTH CARE REFORM

The CM PRESS has been in favor of health care reform for many years--long before the present Sturm und Drang that occupies much of the public discourse these days.

Our reasoning with health care follows our reasoning about government generally.

Here's our reasoning in a nutshell. We, as citizens of this country, are members of the club. We should get a fair and honest return on the money we give to our government and we should get the benefits and privileges of being members of the club; not just the responsibilities. Our money should not be wasted, but should benefit us.

Specifically, we believe we should stop almost all foreign aid. It is obscene that we are giving away billions of our dollars while many of our own citizens are hungry and are not getting medical care, or are so worried about not having medical insurance that they're losing sleep over it. We also believe that we should not be running off into costly foreign wars that don't benefit us.
Right now, we're spending billions of our tax dollars in Iraq and Afghanistan, and in gifts to foreign countries, and that money should be used right here in the U.S. to make life better for our citizens.

So, we come down strongly in favor of a better health care system in the U.S. for members of the club.

However, it has to be done right and all the pieces of such a better plan have to work toward making the whole system work. You can't just change this piece over here and not others or you're going to cause problems. And, we see problems with the present plans because none of them seem to really address the basic underlying structural problems of our present national thinking. Without addressing these underlying structural problems, a new health care plan will have problems.

What do we mean?

We believe that those who qualify for a medical education should get that education for free in exchange for a certain number of years working at a modest living wage while providing free health care to all U.S. citizens. After the free education is worked off, the medical professionals can opt out and open private practices. This will give us the needed doctors, nurses and other professionals that we need.

We also believe that an important piece of the plan must be serious tort reform. We don't want medical professionals throwing caution to the wind because they can't be sued, but at present most medical professionals are too easily sued. This is bad for health care and it's bad for our society.

Another important piece of any plan should be to keep those who are in the country illegally from receiving free health care.

To recap, here are the major things that we feel must be part, not only of any genuine health care reform, but also of any reform of the way the country is being run:

1. Stop wasting our money in phony wars and foreign aid and similar things and ALWAYS use that money to benefit U.S. citizens. They're the members of the club.
2. Free medical education.
3. Tort reform.
4. Citizens get the benefits of citizenship; illegal aliens do not.

Our whole two-party scam system needs revising to allow a realistic chance for third parties to gain some political power.




At the present time, the two parties are both pandering to the multitudes clustered under the center of the bell curve.



The reason is simple: That's where most of the votes are. It's just mathematically certain that most voters are going to be average. This makes the two-parties also want to be average in their positions.



Both parties want to be that just right porridge--not too hot and not too cold--just average.



Under a European system, by contrast, third parties standing firm on principles can stick with those principles and not pander.



To answer our own question posed in the headline: We doubt that Limbaugh will try to do anything to help create the political change we need. His whole subconscious is geared around stark opposites--two opposing teams. Listen to him for a couple of hours and you'll realize that he sees politics as Democrats vs. Republicans, Liberals vs. Conservatives, and our various wars as Our Side against Their Side. Limbaugh's view of reality is that everything is like a football game.



This is a serious and simplistic error in thinking. Reality is not just opposites. We do not just have hot and cold--we have a continuum. We do not just have light and dark--there is a continuum. It is also this way in the political views of voters--there is a continuum.



Of course, there has almost always been a problem with modern third party movements in this country in that they are usually little more than a flash in the pan. They come on the scene and run a big name at the top of the ticket who doesn't have a realistic chance of winning the presidency, and then they effectively disappear once the presidential election is over.



What needs to happen is a revision of our system, as mentioned above, and then the third parties need to build from the bottom up by winning local municipal elections all across the country so that there is a deep back bench of competent politicians on the way up who are struggling with each other to come to the fore based on principles that they believe in and which they want to have others also believe in.



The present system rewards mediocrity and sameness. One coin, two sides. We need some new coins.

LATEST COSTA MESA GANG NEWS

According to a report received this past week from the CMPD, there are 7 active street gangs in Costa Mesa. The largest gang has 71 members and the smallest 19. In total, there are 267 active gang members in Costa Mesa in these 7 gangs.

These numbers appear to be almost the same as the CMPD reported in 2007 in a report to the City Council. However, in the earlier report the active gang members number was given as approximately 300. We're not sure from reading the new report and the old report whether this indicates a net loss of 33 gang members or whether both numbers are just approximations.

From other sources, we understand that all seven gangs are Latino gangs, and while there may be a few non-Latino individuals mixed in, these gangs follow the Latino gang pattern of being turf oriented.More about the significance of this further on.

CM PRESS ANALYSIS: Since the number of gangs and the number of gang members appear to have remained constant over the reporting years, but the number of Gang Contacts and STEP Notices Issued have gone much higher, it appears that the CMPD under its new leadership is working harder to rid Costa Mesa of gangs.

There was no explanation given as to why there was a drop in Firearms Seized, but if we have a chance we'll ask the CMPD.

Now, if the City Council would just help the CMPD by removing or thinning out the slums, we're sure we'd see a big drop in gang activity and gang related crime.

MORE ON "TURF ORIENTED" and STANTON

"Turf oriented" means that the gangs NEED their slum neighborhoods to exist as much as outlaw motorcycle gangs need their motorcycles to exist. Remove the slums and the gangs fade away.

See our article in CM PRESS # 851 or HERE about how the City of Stanton is doing EXACTLY what the CM PRESS has been saying that Costa Mesa should do in this regard, i.e. it is thinning out the slums in that city and putting in green areas and parking.

And, Stanton is also doing it EXACTLY as the CM PRESS has recommended Costa Mesa do it, by not using redevelopment or eminent domain to buy up slum units.

The reason a City such as Stanton or Costa Mesa should not use redevelopment or eminent domain to buy up slum units is because, by law, the City that does this will have to replace the slum units with at least double the number of low income units that is has removed. Thus, a City trying to rid itself of high crime areas, but using redevelopment and eminent domain, often just builds in more high crime areas for the future.

WANT TO STOP AND MAYBE EVEN REVERSE JOHN WAYNE'S GROWTH?

The ONLY way is to come up with an alternative location. If you don't know why, or if you think that you can stop John Wayne's growth by capping flights you may be beyond help.

For several years, the CM PRESS has said that a new international airport should be built on a sliver of Camp Pendleton. LINK to maps of Camp Pendleton.

Here's why Camp Pendleton makes sense:

The CM PRESS Camp Pendleton proposal would only use about 3% of Camp Pendleton. The rest of the present base (97% ) would continue as a military base.

Consider:

John Wayne Airport is 501 acres.

Los Angeles International Airport is 3, 425 acres.

Camp Pendleton is 125,000 acres and has 17 miles of coastline.

You could fit about 250 John Wayne Airports or 36 Los Angeles International Airports on Camp Pendleton.

Take just a tiny 3% of Camp Pendleton and build a state of the art, 100-year-airport there.

This 3% would be 3, 750 acres.

That's 325 acres larger than LAX and 3, 249 acres larger than JWA!

Plus, the planes can take off over the ocean.

This new airport at Camp Pendleton would also have easy freeway access and we wouldn't need to send people on trains into the middle of the desert to get on planes, which is another idea that is being floated in addition to capping.

ABOUT THOSE HELICOPTERS AND THE BUDGET IN COSTA MESA

This is a Eurocopter EC120B. It is similar to, but may not be the exact model, used by the CMPD. It's made in Europe and costs around $1.4 million.




This is a Robinson R44. It is manufactured in Torrance, Ca. and costs about $ 404,000. It appears to be cheaper to operate and maintain than the EC120B. It is not used by the CMPD.

Perhaps the Costa Mesa City Council should ask why the CMPD isn't using a Robinson Helicopter. Maybe there are some very good reasons for not using it, but it doesn't hurt to ask.

HUH? MAYBE IT'S THE VOODOO OR POSSIBLY SOMETHING IN THE WATER?

Here are the opening lines from a column at the 5-day-a-week Daily Voice (LINK), penned by Jim Fitzpatrick, who is Costa Mesa's newest Planning Commissioner:

"I went on a mission once to Haiti. My family has a dear friend, a priest from Boston, who married me and also each of my two brothers."

So, is Fitzpatrick describing a polygamous homosexual priest who is now married to Fitzpatrick and his two brothers?

A little further on, Fitzpatrick writes this:

"They say Haiti is 80% Catholic and 100% voodoo. A poor country, but dawned their Sunday best to attend church as a community."

IS THIS GUY'S COMMENT, WELL...YOU KNOW...?

Here's a letter in the almost daily Daily Pilot today from Dennis Short (LINK), in which Short praises the Pilot for hiring a non-white guy who, in Short's words, provides "a much needed perspective to our mostly white community."

Turn it around. Suppose someone praised a newspaper in a mostly black community for hiring a white guy who provides "a much needed perspective to our mostly black community." What do you think the response would be?

Moving along with Mr. Short, but just a little...

Long time readers may recall that back when the Costa Mesa City Council was working on closing down the Job Center in, ah, Costa Mesa, Short, who lives and works in Newport Beach, came to a Costa Mesa City Council meeting and gave what was supposed to be the moment of silence before the meeting ("moment of silence" is the PC term for prayer), but instead railed against the Council for wanting to close the Job Center.

After that, the CM PRESS tried to contact Short to see if he'd be willing to open a new Job Center on his Church's property in Newport Beach, but we never received a reply.

As we fairly drip with the milk of human kindness, we'd like to repeat our offer:

Mr.Short, how about opening a Job Center on your church's property in Newport Beach?

Let us know if you'd like to do this, and we'll be only too happy to hand out leaflets to the suspected illegal aliens who solicit work from street corners in Costa Mesa, letting them know that they can now look for work at your Church.

ITEM 1: The CM PRESS told the City Council last night that citizens of Costa Mesa should not be paying to have our police helicopter patrol other cities, and that if these other cities wanted this service they should pay their fair share or forget about the helicopter.

Then, lefty Councilmember Katrina Foley said (paraphrasing): The Costa Mesa helicopter should help all cities in Orange County because, gosh, Costa Mesa citizens might be in those cities--such as Irvine--and be crime victims and the Costa Mesa helicopter might help them.
Huh?
So, Costa Mesa citizens must pay $2 million dollars a year for a helicopter and Irvine pays almost nothing. Gee, that makes sense--if you live in Foley's bizarro lefty world. By the way, what's your chance of being a crime victim in Irvine--one of the safest cities in the U.S.? Hmmmm?

ITEM 2: The CM PRESS told the Council that sometimes the Council doesn't always think things through and often looks as though its right hand doesn't know what its left hand is doing.

As an example, we told the Council about something we had previously reported in the CM PRESS, as follows:

May 19, 2009--At the Costa Mesa City Council meeting, the Council gave $ 20,000 of your tax dollars to a charity called MIKA, which is located in the Shalimar slum, and which is run by Crissy Brooks. The Council made this donation of your money after it received a recommendation from the City Council appointed 3R Committee--of which Ms. Brooks is a member. Following so far?

September 25, 2009--The Costa Mesa Police Department arrested 11 day workers who were illegally soliciting work from street corners. Many of them were deported.

September 30, 2009--Crissy Brooks had an article in the Daily Voice in which she told about crying about the deported illegal aliens and about how she had travelled to Tijuana after their deportation to commiserate with them and let them know they had support in Costa Mesa.

After our comments about this, Katrina Foley tried to defend the Council by saying that Ms. Brooks had recused herself from the vote of the 3R Committee that recommended giving her charity $ 20,000.

Huh?

So what? Folks, do you think the other members of the Committee are going to stiff Ms. Brooks? Look, I served on the 3R Committee and I have to tell you there are very few people on that Committee who really watch your money. It's mostly a go along to get along committee.

[When I attended one of the first meetings as a member of the 3R Committee I was aghast that the Committee, with some members who had been there for more than ten years, had never even bothered to check the public record tax forms of the charities that were asking for YOUR money and had no idea of some of the astronomical salaries that the heads of some charities were getting, or how little of YOUR money was actually filtering into the hands of the needy. I then asked the City Council to require that charities supply their 1090's (tax forms), which the Council did.]

And then, Wendy Leece also tried to defend the Council's action in giving the money to Ms. Brooks' charity, by saying that the Council gives money to specific programs within charities, so the $20,000 probably didn't have anything to do with Ms. Brooks' trip to Tijuana.

Huh?

Look folks, money is fungible. When it is given to a charity, part of it goes to pay salaries and overhead. And, if money is found for one program in a charity, it frees up other money. Good grief, Ms. Leece, we know you understand this.

ITEM 3: We told the Council that members should stop the phony crap of telling citizens to buy whatever they need in Costa Mesa, when the Council doesn't do that. We pointed to an item on the agenda that gives $ 420,130 to a landscape company in Palm Desert to do some landscaping in Costa Mesa. The Council then voted to spend your money in Palm Desert. Huh?

ITEM 4: We told the Council, about the nonsense, as we had previously reported in the CM PRESS, of some CMPD officers telling citizens that if they don't like noise from neighboring properties (that violates a Costa Mesa Municipal Code) that the officers won't do anything unless the citizen puts the neighbors under citizen's arrest.

Huh?

Folks, the CMPD has full authority to do something about the noise, without causing a neighborhood war between neighbors, just as it does with stopping barking dogs without having to have a neighbor put a neighboring dog owner under citizen's arrest.

ITEM 5: We told the Council that the CM PRESS has been trying since September 26, to get information from City Hall and the CMPD about gang trends in Costa Mesa but that since our informal requests have been ignored that we have now been forced to file a formal California Public Records Act request to view the information.

Folks, the California Public Records Act was enacted to allow citizens to see what their government is doing and to pierce the veil of secrecy that so many in local governments try to erect to keep citizens in the dark.

ITEM 6: We gave our opinion that the do-nothing, not-needed Parks and Recreation Commission should be eliminated and their functions should be taken over by the Planning Commission. The Council decided to keep both Commissions. Hey, it's only YOUR money that goes to fund these commissions, and so what if City Hall has to be lit up two days for two separate commissions that have almost nothing on their agendas; why, it's all about being pals with your pals--on your dime. Oh, and by the way,be sure that you peons put in low energy light bulbs in your homes to conserve energy--unlike the Silly Council.

COUNCIL MAKES PLANNING COMMISSION APPOINTMENT
The Council appointed Jim Fitzpatrick to the Planning Commission. We don't know much about him other than what we've seen on his resume. He apparently lives on the Eastside and runs a carwash. He seems to have schmoozed with various Councilmembers so they probably figure he's someone who won't rock the boat.

IS THE PAKISTANI OFFENSIVE CALCULATED TO BRING IN MORE U.S. TROOPS-- AND MORE U.S. MONEY--TO HELP A FEW OF OUR 'FRIENDS' IN THE PAKISTANI GOVERNMENT?

As President Obama wrestles with whether or not to send more U.S. troops to Afghanistan, the Pakistani government has launched what is billed as a major offensive against the Taliban.

We see this as little more than a PR move to try to force Obama's hand so he'll send in more U.S. troops and more U.S. money to a situation that is not in our best interests and which will just end up having more of our troops killed for no good reason.

Here's why:

1. One of the big complaints about Afghanistan/Pakistan is that the Taliban are deep within the Pakistani government. Thus, sending U.S. troops to the border area between Afghanistan and Pakistan means we would be sending our troops into an area where they would have enemies on all sides, and every move they make would be known by the armed Taliban from their friends in the Pakistani government.

By doing a show offensive against the Taliban, our puppets in Pakistan may be attempting to show the U.S. Congress and Obama that the Pakistani people really are interested in defeating the Taliban. But, golly, they sure do need American troops and American money to continue the good fight. If we send in more troops, watch as Pakistan quietly backs off its offensive and lets our troops do most of the fighting and dying.

2. In the latest report on Aljazeera (HERE)about the "offensive" by Pakistan to destroy the Taliban, we read that Pakistan is "making progress." Really? Pakistan claims to have killed 78 Taliban. This is progress? Nonsense. The Taliban, as a guerrilla force, are simply melting away into the population. Some say the Taliban have 10,000 troops in the area being attacked by Pakistan. Others say this estimate is low. Either way, reportedly killing 78 of the Taliban is not progress. It's nothing.

Again, we believe Pakistan's offensive is nothing but a show being put on for the Obama administration.

Will Obama be fooled and now say: "The Pakistanis have shown that they'll fight, so we need to support them by sending in more American troops." If so, he is a fool.

CITY COUNCIL APPOINTS NEW PLANNING COMMISSIONER TONIGHT

The CM PRESS hopes the Council will appoint someone who will help with the improvement of the Westside. Unfortunately, we think one improvement obstructionist who wants the seat may have the ear of at least one Councilmember. This improvement obstructionist has made frequent comments in the Daily Pilot that indicate he's a status quo guy who will work to keep the Westside Bluffs full of industrial buildings.

And, which city would you prefer that Costa Mesa be most like--for you and your family?

HEY, CM PRESS YOU KEEP CALLING FOR A REINDUSTRIALIZATION OF CALIFORNIA AND THE U.S. SO WHY DO YOU KEEP CALLING FOR A REDUCTION OF THE INDUSTRIAL ZONING ON THE WESTSIDE BLUFFS?

Whenever we call for reindustrialization, we get comments from industrialists who have industrial properties on Costa Mesa's Westside Bluffs asking some variant of the above question.

The simple answer is that we are in favor of all levels of industrialization from the cleanest R&D uses to the dirtiest M2 uses. However, we are also in favor of having industrial uses in their proper places--which is not on Costa Mesa's Westside Bluffs that have an ocean and California beach influence.

In fact, one of the reasons that the Westside is the worst part of Costa Mesa is because of the 60 acres of industrial uses on land that should be used for executive homes for upwardly mobile people who would like Newport Beach, but who can't afford it. Build those homes on the Bluffs and watch the Westside become one of the nicest areas in Orange County.

And, of course, building those homes is exactly what the Westside plans are about.

Our guess? If a new location for a real international airport isn't found, JWA will eventually expand westward into Costa Mesa over at least to Red Hill, and it may even go beyond that.

CITIZENS TELLING THE CM PRESS THAT THEY'RE NOT HAPPY WITH THE WAY SOME CMPD OFFICERS ARE HANDLING QUALITY OF LIFE VIOLATIONS

As we wrote before, the CM PRESS is hearing from citizens who are complaining to the CMPD about loud parties--that may, in some cases, be regularly scheduled paid events with 25 to 50 people--but are being told by the police that the citizens will have to put the party goers under citizen's arrest in order for the cops to do anything about the problem.

This isn't acceptable and it's not the law.

Furthermore, when the CM PRESS has talked to some high ranking police officers and asked why they refuse to live in Costa Mesa, they've told us that they don't want to be confronted as they go about their daily non-police lives by people they've arrested, and they don't want their children and families put in danger. Okay. So, then why should citizens be put in danger by conducting citizen's arrests of their neighbors? It makes no sense.

To stop the confusion, here's the complete Costa Mesa Municipal Code on the subject of noise. As you can see, the CMPD can act on its own and does not need a citizen to put himself or herself in danger by doing a citizen's arrest:

CHAPTER XIII CMMC
Sec. 13-277. Purpose.
It is the city's purpose to prohibit unnecessary, excessive and annoying noises from all sources subject to its police power. At certain levels noises are detrimental to the health, comfort, safety, peace and enjoyment and welfare of the citizenry, and in the public interest shall be regulated and systematically proscribed.
(Ord. No. 97-11, § 2, 5-5-97)

Sec. 13-278. Definitions.
The following words, phrases and terms as used in this chapter shall have the meaning indicated below:
Cumulative period. An additive period of time composed of individual time segments which may be continuous or interrupted.
Decibel (dB). A unit which denotes the ratio between two (2) quantities which are proportional to power: The number of decibels corresponding to the ratio of two (2) amounts of power is ten (10) times the logarithm to the base 10 of this ratio.
Emergency machinery, vehicle or work. Any machinery, vehicle or work used, employed or performed in an effort to protect, provide or restore safe conditions in the community or for the citizenry, or work by private or public utilities when restoring utility service.
Exterior residential noise environment. The exterior environs of a residential development which include private yard of single-family residence, multi-family private patio or balcony which is served by means of exit from inside the dwelling, private balconies greater than six (6) feet in depth, and common open space areas containing resident-serving amenities (i.e. pool, spa, tennis courts). Exception: For multi-family residential development or live/work units approved pursuant to a master plan in a mixed-use overlay district where the base zoning district is nonresidential, the exterior residential noise environment does not include the following areas: Private balconies or patios regardless of size, private or community roof decks/roof terraces, internal courtyards and landscaped walkways that do not include resident-serving, active recreational uses such as community pool, spa, tennis courts, barbeque, and picnic areas.
Fixed noise source. A stationary device which creates sounds while fixed or motionless, including but not limited to industrial and commercial machinery and equipment, pumps, fans, compressors, generators, air conditioners and refrigeration equipment.
Grading. Any excavating or filling of earth material, or any combination thereof, conducted at a site to prepare the site for construction or other improvements.
Impact noise. The noise produced by the collision of one mass in motion with a second mass which may be either in motion or at rest.
Interior residential noise environment. The interior environs of a residential dwelling unit or live/work unit which includes all interior spaces such as, but not limited to, bathrooms, closets, corridors, kitchen, living room/family room, bedrooms, playroom, and office.
Mobile noise source. Any noise source other than a fixed noise source.
Noise level. The "A" weighted sound pressure level in decibels obtained by using a sound level meter at slow response with a reference pressure of twenty (20) micronewtons per square meter. The unit of measurement shall be designated as dB(A).
Person. A person, firm, association, copartnership, joint venture, corporation or any entity, public or private in nature.
Residential property. A lot of real property which is developed and used either in part or in whole for residential purposes, other than transient uses such as hotels and motels.
Simple tone noise. A noise characterized by a predominant frequency or frequencies so that other frequencies cannot be readily distinguished.
Sound pressure level of a sound, in decibels. Twenty (20) times the logarithm to the base 10 of the ratio of the pressure of the sound to a reference pressure, which reference pressure shall be explicitly stated.

Sec. 13-279. Exceptions.
The provisions of this chapter shall not apply to the following:
(a) Emergency machinery, vehicles, or work; or
(b) Construction equipment, vehicles, or work between the hours of 7:00 a.m. and 8:00 p.m., provided that all required permits for such construction, repair, or remodeling have been obtained from the appropriate city departments.

Sec. 13-280. Exterior noise standards.
(a) The following noise standards, unless otherwise specifically indicated, shall apply to all residential property within the city:
RESIDENTIAL EXTERIOR NOISE STANDARDS

55 dB(A) 7:00 a.m.--11:00 p.m.
50 dB(A) 11:00 p.m.--7:00 a.m.

In the event the alleged offensive noise consists entirely of impact noise, simple tone noise, speech, music, or any combination thereof, each of the above noise levels shall be reduced by five (5) dB(A).
(b) It shall be unlawful for any person at any location within the city to create any noise, or to allow the creation of any noise on property owned, leased, occupied, or otherwise controlled by such person, when the foregoing causes the noise level, when measured on any other residential property, either within or outside the city, to exceed:
(1) The noise standard for a cumulative period of more than thirty (30) minutes in any hour;
(2) The noise standard plus five (5) dB(A) for a cumulative period of more than fifteen (15) minutes in any hour;
(3) The noise standard plus ten (10) dB(A) for a cumulative period of more than five (5) minutes in any hour;
(4) The noise standard plus fifteen (15) dB(A) for a cumulative period of more than one (1) minute in any hour; or
(5) The noise standard plus twenty (20) dB(A) for any period of time.
(c) In the event the ambient noise level exceeds any of the first four noise limit categories above, the cumulative period applicable to said category shall be increased to reflect said ambient noise level. In the event the ambient noise level exceeds the fifth noise limit category, the maximum allowable noise level under said category shall be increased to reflect the maximum ambient noise level.
(d) The exterior noise standards shown in subsection (a) shall not apply to the following exterior areas of multi-family residential development or live/work units located within a mixed-use overlay district where the base zoning district is nonresidential, approved pursuant to a master plan, and subject to the land use regulations of an urban plan:
(1) Private balconies or patios regardless of size;
(2) Private or community roof decks/roof terraces;
(3) Internal courtyards and landscaped walkways that do not include resident-serving, active recreational uses such as community pool, spa, tennis courts, barbeque, and picnic areas.
(e) In high-rise residential developments in the North Costa Mesa Specific Plan, the exterior noise standards shown in subsection (a) shall only apply to the common outdoor recreational amenity areas located on the ground level. Recreational amenity areas located above the ground level and private balconies and patios shall be exempt from this standard.

Sec. 13-281. Interior noise standards.
(a) The following interior noise standards, unless otherwise specifically indicated, shall apply to all residential property within the city:

(1) The interior noise standard for a cumulative period of more than five (5) minutes in any hour;
(2) The interior noise standard plus five (5) dB(A) for a cumulative period of more than one (1) minute in any hour; or
(3) The interior noise standard plus ten (10) dB(A) for any period of time.
(c) In the event the ambient noise level exceeds either of the first two (2) noise limit categories above, the cumulative period applicable to said category shall be increased to reflect said ambient noise level. In the event the ambient noise level exceeds the third noise limit category the maximum allowable noise level under said category shall be increased to reflect the maximum ambient noise level.

Sec. 13-282. Noise near schools, hospitals, churches.
It shall be unlawful for any person to create, maintain or cause to be created or maintained any noise or sound which:
(a) Exceeds the noise standards specified in section 13-280, Exterior noise standards, near any school, hospital or church while it is in use, regardless of the zone within which it is located; or
(b) The noise level unreasonably interferes with the working of such installations or which disturbs or unduly annoys patients in a hospital, provided conspicuous signs are displayed in three (3) separate locations within one-tenth of a mile indicating the presence of a school, church or hospital.
(Ord. No. 97-11, § 2, 5-5-97)

Sec. 13-283. Loud, unnecessary noise.
It shall be unlawful for any person to willfully make or continue, or cause to be made or continued, any loud, unnecessary and unusual noise which disturbs the peace or quiet of any neighborhood or which causes discomfort or annoyance to any reasonable person of normal sensitiveness residing in the area, regardless of whether the noise level exceeds the standards specified in section 13-280, Exterior noise standards, and section 13-281, Interior noise standards. The standard which may be considered in determining whether a violation of the provisions of this section exists may include, but not be limited to, the following:
(a) The level of noise;
(b) Whether the nature of the noise is usual or unusual;
(c) Whether the origin of the noise is natural or unnatural;
(d) The level and intensity of the background noise, if any;
(e) The proximity of the noise to residential sleeping facilities;
(f) The nature and zoning of the area within which the noise emanates;
(g) The density of the inhabitation of the area within which the noise emanates;
(h) The time of the day and night the noise occurs;
(i) The duration of the noise;
(j) Whether the noise is recurrent, intermittent or constant;
(k) Whether the noise is produced by a commercial or noncommercial activity; and
(l) The density of the inhabitation of the area affected.

Sec. 13-284. Noise level measurement.
(a) Any noise level measurement shall be performed using a sound level meter meeting American National Standard Institute's Standard S1.4-1971 for Type 1 or Type 2 sound level meters or an instrument and the associated recording and analyzing equipment which will provide equivalent data.
(b) Exterior measurements: The location selected for measuring exterior noise levels shall be at any point on the affected property.
(c) Interior measurements: Interior noise measurements shall be made within the affected dwelling unit. The measurement shall be made at a point at least four (4) feet from the wall, ceiling, or floor nearest the alleged offensive noise source and may be made with the windows of the affected unit open.

Sec. 13-285. Variance procedure.
(a) The owner or operator of a noise source which violates any provision of this chapter may file an application with the development services director for a variance from the provisions of this chapter. Variance applications shall be processed according to procedures set forth in Chapter III, Planning Applications. The application shall set forth all actions taken to comply with this chapter, the reasons immediate compliance cannot be achieved, a proposed method and time schedule for achieving compliance, and any other information requested by the director.
(b) An applicant shall remain subject to prosecution under the terms of this chapter until a variance is granted.
(c) All applications shall be evaluated with respect to time for compliance, subject to any conditions deemed reasonable to achieve maximum compliance with this chapter. Each variance granted shall set forth the approved method and time schedule for achieving compliance. Evaluation of the variance request shall include consideration of the magnitude of the noise nuisance; the uses of property affected by the noise; the time factors related to study, design, financing, and construction of remedial work; the economic factors related to age and useful life of equipment; and the general public interest and welfare.

Sec. 13-286. Violations.
(a) Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding one thousand dollars ($1,000.00) and/or be imprisoned in the county jail for a period not exceeding six (6) months. Each violation may instead be charged as an infraction.
(b) Each time an offensive noise exceeds any one (1) of the standards set forth in this chapter shall constitute a separate offense and be punishable as such.

Sec. 13-287. Nuisance declared.
It is determined that certain noise levels are detrimental to the public health, welfare and safety and contrary to public interest, and therefore the city council does ordain and declare that the creating or maintaining or causing or allowing to be created or maintained any noise in a manner prohibited by or not in conformity with the terms of this chapter is a public nuisance and shall be punishable as such and may be subject to abatement pursuant to Chapter I, General, Article 4, Enforcement.
